These Terms of Service govern your use of SolarWorldCanada.com and any purchase, quotation, design service, consultation, pickup, shipment or other transaction with Solar World Canada.


Throughout these Terms, “Solar World Canada,” “we,” “us” and “our” refer to Solar World Canada. “Customer,” “you” and “your” refer to the person or organization using the website, requesting a quotation or purchasing products or services.


By visiting our website, requesting a quotation, submitting an order, paying an invoice or purchasing from us, you agree to these Terms of Service and to any other policies referenced in them, including our Return and Refund Policy, Shipping Policy and Privacy Policy.


If you do not agree with these Terms, do not use the website or submit an order.


1. Eligibility and Authority


You must be at least the age of majority in your province or territory to place an order.


If you purchase on behalf of a company, organization, property owner or another person, you confirm that you have authority to bind that party to these Terms and to approve the purchase.


You are responsible for providing accurate contact, billing, shipping, project and equipment information.


2. Online Store and Website Use


You may use this website only for lawful purposes.


You must not:


  • Use the website for fraudulent, misleading or unlawful activity
  • Attempt to interfere with the website, checkout or security systems
  • Upload malicious code, viruses or harmful material
  • Copy, reproduce or exploit website content without permission
  • Use false identity, billing, delivery or payment information
  • Place orders with no intention of completing payment
  • Use automated tools to scrape pricing, product data or proprietary content without written permission


We may refuse access, cancel an order or terminate service where fraud, abuse, unauthorized activity or a violation of these Terms is suspected.


3. Product Information


We make reasonable efforts to provide accurate product descriptions, specifications, images, prices and availability.


Product images may be representative. Colour, packaging, labels, connectors, accessories, dimensions and other details may vary due to manufacturer changes or supplier updates.


Customers are responsible for reviewing:


  • Product model numbers
  • Electrical specifications
  • Voltage and current limits
  • Dimensions and weight
  • Battery chemistry
  • Equipment compatibility
  • Installation requirements
  • Manufacturer documentation
  • Applicable codes, permits and inspection requirements


Contact Solar World Canada before ordering if you are uncertain whether a product is suitable for your system.


We may correct typographical errors, pricing errors, inaccurate descriptions or technical information at any time.


4. Solar and Electrical System Compatibility


Solar panels, charge controllers, inverters, batteries, racking, microinverters and related electrical equipment must be properly matched.


Compatibility may depend on:


  • Open-circuit voltage
  • Operating voltage
  • Short-circuit current
  • Controller or inverter input limits
  • Battery voltage and chemistry
  • Array size
  • Temperature conditions
  • Wire length and conductor size
  • Fuse, breaker and disconnect requirements
  • Grounding and bonding
  • Roof structure and mounting method
  • Local electrical and building codes


General information provided by Solar World Canada is not a substitute for site-specific engineering, electrical design, inspection or installation by a qualified professional.


The customer is responsible for confirming final compatibility and safe installation unless Solar World Canada has specifically agreed in writing to provide a paid design or installation service covering those matters.


5. Prices, Taxes and Currency


Unless otherwise stated:


  • Prices are listed in Canadian dollars
  • Applicable taxes are additional
  • Shipping, freight, brokerage, delivery and installation are additional
  • Prices may change without notice
  • A quotation is valid only for the period stated on the quotation
  • Promotional pricing may end when the promotion expires or inventory is sold


A website price does not guarantee availability.


If a product is listed at an incorrect price due to an error, we may contact you before fulfillment to offer the correct price or cancel and refund the affected item.


6. Orders and Acceptance


Submitting an order does not guarantee acceptance.


An order is accepted only after:


  • Payment has been approved or agreed payment terms have been satisfied
  • Inventory has been confirmed
  • Product availability has been verified
  • Any required freight or delivery charges have been accepted
  • Any compatibility or special-order conditions have been addressed


We may refuse, limit or cancel an order for reasons including:


  • Inventory errors
  • Supplier shortages
  • Pricing errors
  • Suspected fraud
  • Payment failure
  • Shipping restrictions
  • Product compatibility concerns
  • Unavailable freight service
  • Incorrect customer information
  • Orders placed for resale without prior approval


If we cancel a paid order before fulfillment, we will issue the appropriate refund, less any properly disclosed non-refundable design, administrative, supplier or special-order costs.


7. Quotations and Proposals


Quotations are based on the information available when they are prepared.


Unless expressly included, a quotation does not automatically include:


  • Engineering
  • Permits
  • Utility applications
  • Structural review
  • Electrical inspection
  • Installation labour
  • Travel
  • Crane or lifting services
  • Trenching
  • Roof repair
  • Service upgrades
  • Freight or remote delivery
  • Taxes
  • Equipment not specifically listed


Prices and availability may change after the quotation expiry date.


Changes requested by the customer may require a revised quotation and additional fees.


Verbal estimates are not binding unless confirmed in writing.


8. Administrative, Consultation and System-Design Services


Solar World Canada may provide consultation, system design, equipment selection, quotation preparation, drawings, calculations, permit preparation, sourcing or project-planning services.


Reasonable fees may apply for:


  • Detailed custom system designs
  • Equipment compatibility research
  • Multiple quotation revisions
  • Site-specific layouts
  • Electrical calculations
  • Permit or utility documentation
  • Supplier coordination
  • Special-order sourcing
  • Project administration
  • Work performed before a project is cancelled


Any paid administrative, consultation or design service will be disclosed to the customer and agreed to before the chargeable work begins.


Where agreed work has already been completed, the applicable fee remains payable even if the customer does not proceed with the equipment purchase or installation.


Design documents remain the intellectual property of Solar World Canada until all related fees are paid.


9. Payment


Payment is due according to the checkout, quotation, invoice or written payment schedule.


We may require:


  • Full payment before pickup or shipment
  • A deposit
  • Progress payments
  • Final payment before release of equipment
  • Cleared funds before fulfillment


Deposits may become non-refundable where they have been used for:


  • Special-order products
  • Supplier commitments
  • Custom design
  • Permit work
  • Procurement
  • Freight
  • Administrative work
  • Reserved inventory


Any non-refundable portion will be disclosed before payment where required.


The customer is responsible for bank, payment-processing, chargeback, financing or currency-conversion costs charged by their own provider.


We may suspend fulfillment where payment is overdue, reversed, disputed or placed on hold.


10. Fraud, Payment Disputes and Chargebacks


Customers must contact Solar World Canada promptly if they believe a payment or order is incorrect.


Filing an unjustified chargeback or payment dispute while retaining products, services, design work or other value may delay fulfillment and may result in the account being suspended while the matter is investigated.


We may provide invoices, communications, delivery records, order confirmations and other evidence to payment providers or financial institutions when responding to a dispute.


Nothing in this section restricts a customer’s lawful right to dispute an unauthorized or incorrect charge.


11. Inventory and Product Availability


Inventory displayed online may change before an order is processed.


Products may be:


  • In stock
  • Supplier stock
  • Inbound
  • Special order
  • Temporarily unavailable
  • Subject to allocation


We may substitute an item only with the customer’s approval.


We are not responsible for supplier discontinuations, manufacturing delays, allocation limits or stock shortages outside our reasonable control.


12. Calgary Warehouse Pickup


Calgary warehouse pickup is available by appointment only.


Customers must wait until Solar World Canada confirms:


  • The order is paid or approved
  • The order is complete
  • The equipment is ready
  • The pickup date and time
  • Any loading or vehicle requirements


We do not guarantee unscheduled walk-in service.

 

The customer is responsible for arriving with a suitable vehicle, restraints, padding and safe load capacity.

Once products have been inspected and accepted at pickup, the customer is responsible for safe loading, transportation and protection of the equipment, except where Solar World Canada has expressly agreed to load or deliver it.

13. Shipping, Freight and Delivery

Shipping, freight and delivery are governed by our Shipping Policy.

Large or heavy items, including solar panels, pallets, batteries and inverters, may require a separate freight quotation.

Delivery dates are estimates and are not guaranteed.

Delays may occur because of:

  • Carrier delays
  • Weather
  • Road closures
  • Remote destinations
  • Supplier delays
  • Customs or brokerage
  • Labour disruptions
  • Events outside our reasonable control

Customers must inspect shipments on delivery and report damage according to our Shipping Policy.

14. Risk of Loss and Title

Responsibility for products transfers to the customer when:

  • The customer or their representative takes possession at pickup
  • The shipment is delivered to the customer
  • The shipment is delivered to the customer’s designated address or authorized recipient

Where permitted by law, title to unpaid products remains with Solar World Canada until all amounts owing have been paid in full.

This section does not limit any mandatory consumer rights or carrier obligations.

15. Returns, Refunds, Exchanges and Cancellations

Returns, refunds, exchanges and cancellations are governed by our published Return and Refund Policy.

A 20% restocking fee may apply to approved returns, exchanges or cancellations.

The customer may also be responsible for:

  • Return shipping
  • Freight
  • Packaging
  • Insurance
  • Brokerage
  • Supplier cancellation charges
  • Administrative fees
  • Consultation fees
  • Quotation or design fees
  • Repackaging or missing-component costs

Fees apply only where properly disclosed, agreed to or legally permitted.

Non-returnable items may include batteries, installed equipment, special-order goods, custom-configured systems, cut wire, clearance products and used or damaged products, subject to applicable law.

Nothing in these Terms removes any consumer right that cannot legally be excluded.

16. Special-Order and Custom Products

Special-order, custom-sourced, custom-designed or custom-configured products may not be cancellable or returnable after:

  • The supplier order has been placed
  • Manufacturing has begun
  • Configuration has begun
  • Materials have been cut
  • Custom work has started
  • Freight has been booked

Any supplier cancellation fee, restocking fee, freight cost or unrecoverable expense may be charged to the customer where disclosed and legally permitted.

17. Installation

Unless installation is specifically included in writing, products are sold on a supply-only basis.

Installation must be performed safely and in accordance with:

  • Manufacturer instructions
  • Electrical codes
  • Building codes
  • Permit requirements
  • Inspection requirements
  • Utility rules
  • Applicable laws

Solar World Canada is not responsible for damage, injury, malfunction or loss caused by:

  • Improper installation
  • Incorrect wiring
  • Reversed polarity
  • Overvoltage or overcurrent
  • Undersized conductors
  • Missing electrical protection
  • Inadequate ventilation
  • Improper mounting
  • Water intrusion
  • Failure to follow manufacturer instructions
  • Unauthorized modification
  • Use outside product specifications

Where Solar World Canada arranges an independent installer, the installer may operate as a separate contractor unless otherwise stated in writing.

18. Permits, Codes and Utility Approval

The customer is responsible for determining whether permits, inspections, engineering, utility approval or licensed trades are required unless those services are specifically included in writing.

Approval by a utility, municipality, electrical authority, inspector or other third party is not guaranteed.

Changes required by an authority having jurisdiction may result in additional equipment, labour, design or permit costs.

19. Manufacturer Specifications and Warranties

Products may include warranties provided by the manufacturer.

Warranty duration, coverage, exclusions and remedies are determined by the manufacturer.

A warranty claim may require:

  • Proof of purchase
  • Serial numbers
  • Photographs
  • Troubleshooting
  • Operating data
  • Installation records
  • Return of the product
  • Manufacturer inspection

Solar World Canada may assist with a warranty claim but does not control the manufacturer’s decision or processing time.

Unless expressly included by the manufacturer or agreed in writing, warranty coverage does not include:

  • Labour
  • Removal
  • Reinstallation
  • Travel
  • Shipping
  • Freight
  • Diagnostics
  • Lost production
  • Lost revenue
  • Temporary replacement equipment

Nothing in this section excludes warranties or remedies required by law.

20. Third-Party Products and Services

Our website may contain products, services, payment systems, applications, links or content provided by third parties.

We are not responsible for third-party websites, manufacturers, carriers, installers, payment providers or service providers beyond obligations imposed by law.

Customers should review the terms and policies of any third party involved in their transaction.

21. Financing and Payment Providers

Financing, payment plans and third-party payment services are subject to the provider’s approval and terms.

Solar World Canada does not guarantee:

  • Financing approval
  • Credit limits
  • Interest rates
  • Payment-provider availability
  • Processing time

Any dispute concerning a third-party financing agreement may also be subject to that provider’s terms.

22. Accuracy of Billing and Account Information

You agree to provide current, complete and accurate:

  • Name
  • Email
  • Phone number
  • Billing address
  • Shipping address
  • Payment information
  • Project information

You must promptly update information that changes.

We are not responsible for delays or losses caused by incorrect information supplied by the customer.

23. Intellectual Property

All website content, branding, graphics, photographs, designs, proposals, drawings, written materials and original system documents are owned by Solar World Canada or used under licence.

You may not reproduce, publish, sell, distribute or commercially use our content without written permission.

A customer may use fully paid project-specific documents for the project for which they were prepared, unless otherwise agreed in writing.

24. Reviews, Feedback and Communications

If you submit a review, testimonial, photograph, suggestion or other feedback, you confirm that:

  • It is truthful
  • You have the right to submit it
  • It does not violate another person’s rights
  • It is not unlawful, defamatory or misleading

We may use voluntarily submitted feedback for business and promotional purposes, subject to our Privacy Policy and applicable law.

25. Privacy

Personal information is collected, used and protected according to our Privacy Policy.

By submitting an order or inquiry, you authorize us to use the information reasonably necessary to:

  • Respond to you
  • Process payment
  • Fulfil the order
  • Arrange pickup or delivery
  • Provide customer support
  • Prevent fraud
  • Meet legal obligations

Marketing messages will be sent only where permitted and may be unsubscribed from using the provided method.

26. Errors, Omissions and Corrections

We may change, suspend or discontinue website features without notice.

28. Limitation of Liability

To the maximum extent permitted by law, Solar World Canada is not liable for indirect, incidental, special, punitive or consequential losses resulting from:

  • Delivery delay
  • Supplier delay
  • Improper installation
  • Product misuse
  • Incompatible system design
  • Lost production
  • Lost revenue
  • Lost profits
  • Data loss
  • Business interruption

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any consumer right or remedy that cannot legally be excluded.

29. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims or expenses caused by:

  • Your unlawful use of the website
  • Your violation of these Terms
  • False information you provide
  • Unauthorized resale representations
  • Improper installation or modification
  • Your violation of another person’s rights

This provision does not require a consumer to indemnify Solar World Canada for our own negligence, unlawful conduct or breach of legal obligations.

 

30. Force Majeure

Solar World Canada is not responsible for delay or failure caused by events beyond our reasonable control, including:

  • Natural disasters
  • Fire
  • Flood
  • Severe weather
  • War
  • Civil unrest
  • Government restrictions
  • Labour disputes
  • Transportation interruptions
  • Supplier failures
  • Utility outages
  • Cyberattacks
  • Public-health emergencies

Affected obligations will be delayed for the duration of the event where reasonably necessary.

31. Severability

If any provision of these Terms is found unlawful, invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

32. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

A waiver is effective only when confirmed in writing by Solar World Canada.

33. Entire Agreement

These Terms, together with the applicable quotation, invoice, order confirmation and published store policies, form the entire agreement concerning the transaction.

Where a signed quotation, proposal or contract contains terms that specifically differ from these website Terms, the signed document will control for that transaction.

34. Changes to These Terms

We may update these Terms from time to time.

Changes apply when published, except where applicable law or an existing written agreement requires otherwise.

The version in effect when an order is accepted generally applies to that order unless the parties agree otherwise.

35. Governing Law

These Terms are governed by the laws of Alberta and the applicable federal laws of Canada.

Any dispute may be brought before a court or tribunal having lawful jurisdiction.

Nothing in these Terms requires a consumer to waive a statutory right, mandatory remedy or lawful access to the courts.

36. Consumer Protection

Nothing in these Terms limits or removes any right, protection or remedy that cannot legally be excluded under Canadian or Alberta law.

Where these Terms conflict with mandatory law, the mandatory law will apply.
